从事零售业务的外商投资商业企业在其所在地省级行政区域内开设店铺，如符合以下条件且经营范围不涉及电视、电话、邮购、互联网络、自动售货机销售及本办法第十七条、十八条所列商品的，由该省级商务主管部门在其审批权限内审批并报商务部备案。
