Anyone who poaches on or seizes others' aquatic products, or damages others' aquaculture water bodies and facilities shall be ordered by the department of fishery administration or its subordinate fishery superintendency agencies to compensate for the damages and shall be concurrently fined.

第二十九条偷捕、抢夺他人养殖的水产品的，破坏他人养殖水体、养殖设施的，由渔业行政主管部门或者其所属的渔政监督管理机构责令赔偿损失，并处罚款；数额较大，情节严重的，依照《刑法》第一百五十一条或者第一百五十六条的规定对个人或者单位直接责任人员追究刑事责任。

In this paper, the author proposes own opinions on the application of liability without fault in Chinese civil liability ,the means of bearing liability by administrative department in Chinese administrative anti-trust .insisting on propounding a new clause of anti-trust crime in Chinese criminal law and perfecting procedure laws .As a result ,the author tries to propose forceful theoretical support and reasonable legal suggestions upon the future legal liability system of Chinese anti-trust.

在文中，笔者就民事责任应采用双轨制归责原则、强化行政垄断主体的法律责任、在刑法分则中增加垄断罪条款以及完善法律责任追究程序等问题提出了自己的见解，力争能为我国将来合理设计具有中国特色的反垄断法法律责任制度提供有力的理论支持与合理的法律建议。

Article 38 Where, in violation of the provisions of Article 32 of these Measures, the overseas branch of a Chinese-funded financial institution repatriates the funds raised overseas for use in China without authorization, the foreign exchange bureau shall order it to make corrections and shall give the domestic Chinese-funded financial institution a warning, circulate a notice of criticism and impose a fine of not less than RMB 100,000 yuan nor more than RMB500.000 yuan.

第三十九条境内机构向外汇局报送虚假、无效的文件和资料，骗取外汇局批准的，由外汇局收回批准文件，并对其按第三十五条的规定处罚。构成犯罪的，依法追究刑事责任。

Article 78 Approving the occupation of land without the power of approval, beyond the term of reference, or not according to the purposes defined in the general plans for the utilization of land or approving the occupation or requisitioning of land in violation of the legal procedures, the documents of approval shall be invalid and the persons in charge and personnel directly responsible for illegal requisition or use of land shall be given administrative punishments. Whereas the case constitutes a crime, criminal responsibilities shall be affixed. The land illegally approved and used shall be recovered.

第七十八条无权批准征用、使用土地的单位或者个人非法批准占用土地的，超越批准权限非法批准占用土地的，不按照土地利用总体规划确定的用途批准用地的，或者违反法律规定的程序批准占用、征用土地的，其批准文件无效，对非法批准征用、使用土地的直接负责的主管人员和其他直接责任人员，依法给予行政处分；构成犯罪的，依法追究刑事责任。

Article 51 Anyone who retaliates or makes a false charge against the auditor shall be given sanctions; and shall be subject to criminal liabilities if any crime is constituted.

Article 101 The employer that unjustifiably prevent labour administrative departments and other relevant departments as well as their workers from exercising supervision and inspection powers or retaliates informers shall be fined by labour administrative departments or other relevant departments.

第一百零一条用人单位无理阻挠劳动行政部门、有关部门及其工作人员行使监督检查权，打击报复举报人员的，由劳动行政部门或者有关部门处以罚款；构成犯罪的，对责任人员依法追究刑事责任。

Article 74 A construction enterprise which has been found to have scamped work and used inferior materials, unqualified construction materials, parts and components and equipment or have other acts inconsistent with the blueprints or technical standards shall be ordered to correct itself and imposed fine penalties.

第七十四条建筑施工企业在施工中偷工减料的，使用不合格的建筑材料、建筑构配件和设备的，或者有其他不按照工程设计图纸或者施工技术标准施工的行为的，责令改正，处以罚款；情节严重的，责令停业整顿，降低资质等级或者吊销资质证书；造成建筑工程质量不符合规定的质量标准的，负责返工、修理，并赔偿因此造成的损失；构成犯罪的，依法追究刑事责任。

Article 19 Whoever desecrate s the National Flag of the PRC by publicly and wilfully burning, mutilating, scrawling on, defiling or trampling upon it shall be investigated for criminal responsibilities according to law
