违反法律

Construction contract in construction project is a special contractor's agreement. The homologation of the validity of a contract should obey the provisions from the General Principles of Civil Law and the Contract Law. But the new situations, new problems arised from the process of construction market in our country should be considered to make the corresponding countermeasures, which should not break the principle of law.

建设工程施工合同是特殊形式的承揽合同，其效力认定首先应依据《民法通则》和《合同法》等基本法律关于合同效力的原则规定，同时可以结合我国建设市场发展过程中出现的新情况、新问题来制定相应的处理对策，但不应该违反法律的原则性规定。
