Policy. This article works over the laws and practices of the cargo insurance and probes into the insurance contract about the concluding,the performing,the claiming for compensation,the compensation,the dissention and solving,the existent problem and the countermeasures in order to help the trader with insurance knowledge.

本论文主要参照中国人民保险公司海洋运输货物险条款，研究海上运输货物保险法律与实务，探讨保险合同的订立、履行、索赔与理赔、纠纷与处理、存在问题及其发展对策，为国际贸易当事人提供货物运输保险法律知识与实务操作方法。

The article is made of seven parts:1. The maritime cargo insurance ensures the international trade to perform;2. The concluding and performing of the contract;3. PICC cargo insurance;4. The claiming and compensation;5. The dissention and solving of the contract;6. The existent problem in the cargo insurance;7. Probe into the countermeasures.

本论文分为七个部分：一、海上货物运输保险是国际贸易顺利进行的重要保障；二、海上运输货物保险合同的订立及履行；三、PICC(The Peoples Insurance Company of China)海洋运输货物险；四、索赔与理赔；五、海上运输货物保险纠纷与处理；六、海上运输货物保险发展中存在的问题；七、海上运输货物保险发展对策探讨。

中国人民保险公司根据被保险人的要求，由被保险人向本公司缴付约定的保险费，按照本保险但承保险别和背面所列条款与下列特款承保下述货物运输保险，特立本保险单。

Any shipper or passenger may, on voluntary basis, enter into insured transport of valued goods or buy insurance policy for transport of goods, or may do without.

托运人或者旅客根据自愿，可以办理保价运输，也可以办理货物运输保险；还可以既不办理保价运输，也不办理货物运输保险。

The author, basing on the basic theories of insurable interest, studies some important theoretic questions of marine insurable interest, including what may amount to a marine insurable interest and when and to whom it should be required and how it should be recognized, transferred, terminated and classified; inquires into the insurable interest of several representative types of marine insurance contracts, including contract of marine insurance for Hulls, for the Carriage of Goods by Sea, for Freights, for Interests of Ships Mortgagees and for Liability; oppugns the provisions in insurance laws of our country on subject matter insured, double insurance and insurable interest.

为此，笔者以保险利益的基本理论为基础，对何种利益可以作为海上保险利益，具有海上保险利益的人和时间及海上保险利益应如何认定、移转、消灭和分类等一些重要理论问题进行了研究；对几种典型海上保险合同，包括船舶保险合同、海上货物运输保险合同、运费保险合同、船舶抵押权人利益保险合同及责任保险合同中的保险利益问题进行了探讨；并对我国保险立法中关于保险标的、重复保险及保险利益的规定提出了质疑。
