从《明会典》以行政法典的形式来确立吏治目标，到《大明律》、《明大诰》重典治吏思想的提出，到明中后期《问刑条例》因时立法、情法适中、宽厚待吏的适时调整，明代统治集团在整肃吏治上可谓费尽心机，但腐败始终被后人看作明代官场的最后鉴定，整个明代尤其是中后期，贪风日盛、贿赂公行，究其原因，社会总体机制下制度性因素和文化因素是最根本的，那就是中国传统的官利一体化的价值观，当官与发财是划等号的，经济利益不是通过经济方式而是通过政治方式来解决，这本身就是一种不正常的社会状态。

Abstract］ Interim freeze right is an important right delegated to competent authority under the State Council by "The Law on Anti-Money Laundering of the People's Republic of China." Exercise of this right will heavily influence financial institutions, legal persons, economic organizations, citizens and the society at large. However, due to its imperfect theoretical design and inaccurate wording, this right is theoretically unfeasible and operationally inapplicable. There exists a paradox between freeze and defreeze, bringing about some adverse effects.

摘 要］临时冻结权是《中华人民共和国反洗钱法》赋予国务院反洗钱行政主管部门的一项重要权力，这项权力的行使，必将对金融机构、法人、经济组织、公民和全社会产生重大的影响，但它在理论设计上的不完善以及文字表达方面的不准确完整，导致了这项权力行使的理论可行性和实践操作性不强，存在冻结与解冻的矛盾悖论，并产生某些负面作用，其关于临时冻结权的规定应及时予以修改完善。

From the angle of existing water legislation, the thesis analyzes relevant management legislation and identifies such setbacks as unestablished water right transfer system, irrational price mechanism, unfavorable factors related to management system, unflexible legal liability. Then it puts forward proposals for improvement from the angle of water system, water payable utilization system and water industry access system. In response to the problems with existing law and rules, the thesis brings forward some inputs regarding local rules and regulations with local characteristics which offer effective Countermeasures for current water resources management.

从山西省现行水资源管理立法的主要内容入手，通过对一些相关的管理立法的评价分析，找出其中的不足，例如水权转让制度的尚未确立，水资源价格机制的不合理，管理体制上的不利人为因素，法律责任的过于原则等，深入分析，阐述思路，从山西的水权制度及水环境行政管理制度中的排污收费制度和水资源有偿使用制度及水行业市场准入制度方面提出改善意见，针对现行法律、法规中存在的问题，提出修改建议并制定出具有山西特色的地方性法规、规章，切实有效地为解决山西水资源管理中存在的问题提供法律对策，这是我们的目标。

So the improvement and enlargement of the scope of judicial review of administrative actions in China is both unavoidable and clear: to make amendments to the administrative litigation law to review "abstract administrative actions","final administrative actions" and "inner administrative actions";to delete detailed listing of "reviewable administrative actions" and to establish the essential rule in administrative litigation that any administrative actions shall be judicially reviewable unless the litigation is definitely forbidden by law and harmful to the principle of rule of law.

上述看似疏忽与不慎的用词，恰恰折射出作为国家最高审判机关在行政诉讼受案范围问题上的扩大倾向与面对立法现实的无奈。因为根据我国目前最高审判机关的司法解释的权限，最高人民法院只有依照法律和行政法规，适用法律法规的具体作出解释的权力，而不能似英、美普通法系国家那样&法官造法&，更不能以司法解释权侵夺国家的立法权。
