Part fiveraises several suggestions for perfecting our trademark law. First, it should expand trademark"s function and expand trademark protection range. Second, it should strengthen the effect of Unti-unaffair Completion Law for trademark protection. Third, in legislation of our country, it should endow the people"s courts with the right to affirm the resound trademark right. Four, it should allow the trademark right owners to protect their trademark rights with recovery trademark and allying trademark. Five, it should increase the relative accusals to strike trademark torts. Finally, it should make a uniform intellectual code to change the dispersive legislation mode.

第五部分是本文的创新点和重点，针对我国立法的现状，提出完善我国商标立法的几点建议：其一，扩大商标法保护的对象，其中包括扩大商标的概念；在商标权的授予上，采用使用主义和注册主义相结合的混合原则，扩大商标法保护范围；其二，加强反不正当竞争法在我国商标保护中的作用；其三，立法应允许商标所有人运用防御商标、联合商标来预防和抵制他人的侵权；其四，增加、充实有关罪名，打击商标侵权犯罪行为；其六，制定我国统一的知识产权法典，改变分散的立法模式。

In order to overcome the above-mentioned gaps of the Client/Server computing model of the current GIS, this research introduces Agent technology originated from Artificial Intelligence to GIS. The thesis proposes a new kind of Agent - GeoAgent and expatiates upon its characteristics, behaviors and architecture of corresponding GeoAgent System. A GeoAgent prototype system has been implemented, based on IBM Agent Software Development Kit Aglets. And then, this research proposes GeoAgent-based Geospatial Information Services, followed by detailed theoretical analysis.

针对现有地理信息系统在分布式计算模式方面的不足，本文引入了人工智能领域中Agent的理念，提出了GeoAgent的概念；系统地阐述了GeoAgent的特点、行为、优势和结构，以及GeoAgent系统的体系结构；利用IBM的开发平台Aglets，设计并实现了相应的系统原型；在此基础上，本文提出了基于GeoAgent的空间信息服务的理念，并详细分析了这种空间信息服务的特点和优势。

Aiming at the core of institutional corruption-the abusing of public power by the employees of administration authorities, the article probes with the theory of rent-seeking the breeding mechanism of corruption activities from the following three points:Rent-creating of government, rent-seeking with bribing of enterprises and the game equilibrium between bribees and bribers, points out that the rent-creating of government is the root of corruption and analyzes the differences of rent-seeking ways with bribing means between state-owned and private-owned enterprises.

对应于系统性腐败的核心部份，即&拥有行政权威的公共部门工作人员公共权力的滥用&，运用寻租理论从政府创租、企业以贿赂方式寻租、腐败的博弈均衡三个方面对腐败行为的发生机制进行了探讨，提出政府创租是腐败之源，并分析了国有企业与民营企业在以贿赂方式寻租模式上的区别。
