文章的第三部分则是在前两个部分的基础上提出自己的观点，从刑事责任能力认定的角度来分析原因自由行为的可罚性问题，通过将自陷于无责任能力状态或者限制责任能力状态的行为人依然推定为完全刑事责任能力人的方式，来解决原因自由行为的可罚性，协调其与罪责原则与罪刑法定原则之间的关系。
