Article 46 Where the person in charge of a unit persecutes or retaliates against the accounting personnel, who perform their duties according to law and oppose acts violating the provisions of this Law, by means of demoting to a lower rank, removing from post,transferring working post,dismissing from employment or expelling from the units, etc., and therefore constitute a crime, criminal responsibility shall be investigated in accordance with law; if no crime is constituted, administrative sanctions shall be imposed according to law by the units to which they belong or the unit concerned.

第四十六条单位负责人对依法履行职责、抵制违反本法规定行为的会计人员以降级、撤职、调离工作岗位、解聘或者开除等方式实行打击报复，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，由其所在单位或者有关单位依法给予行政处分。

Based on the concept and theory of liability without fault, this article discusses the 76th statute in the Law of On-road Traffic Safety, which says that the liability without fault gauge will be applicable if there is an accident between motor vehicle and a non-motor vehicle or pedestrians. It also elaborates the significance of the principle of applying the liability without fault in traffic accident cases. It means that besides intentionally, the non-motor vehicle driver or pedestrians don't have to pay the loss of the side of motor vehicle, even though there is a severe mistake by non-motor vehicle driver or pedestrians. This conclusion disaffirms that the damaged motor vehicle may claim for compensation to the non-motor vehicle driver or pedestrians.

本文从无过错责任概念及其理论依据入手，论述了《道路交通安全法》第七十六条规定的机动车与非机动车驾驶人、行人之间发生交通事故实行无过错责任归责原则，并详细阐释了在交通事故损害赔偿中适用无过错责任原则的功能，从而得出了机动车与非机动车驾驶人、行人之间发生交通事故，非机动车驾驶人、行人除故意外，即使存在重大过错，也不应当对机动车一方的损失承担赔偿责任的结论，否定了有损失的机动车一方可以向非机动车驾驶人或者行人索赔的观点。

第九十六条外资法人机构自行解散或独资银行、合资银行和外国银行关闭其在中国境内分行涉及的其他清算事宜按照《中华人民共和国公司法》的有关规定执行。

Article 36 Where, after bankruptcy declaration, the bankrupt enterprise's properties are sealed up, distrained or frozen in other civil procedures, the people's court that accepts the bankruptcy case shall immediately notify the people's court that takes the measure of sealing up, distraining or freezing the properties to cancel the measure, and handle the transfer formalities to the people's court that accepts the bankruptcy case.

第三十六条破产宣告后，破产企业的财产在其他民事诉讼程序中被查封、扣押、冻结的，受理破产案件的人民法院应当立即通知采取查封、扣押、冻结措施的人民法院予以解除，并向受理破产案件的人民法院办理移交手续。

Article 36 The administrative departments of work safety of the people's governments at the districted municipality level or at the county level shall take charge of the daily supervision or examination of the hazardous chemical production enterprises that have obtained work safety licenses within the administrative regions thereof and shall report any problem as found in the supervision and examination to the administrative organ in charge of issuing work safety licenses in a timely manner.

第三十六条设区的市、县级人民政府安全生产监督管理部门负责本行政区域内取得安全生产许可证的危险化学品生产企业的日常监督检查，并将监督检查中发现的问题及时报告安全生产许可证颁发管理机关。

第七十六条人民检察院在审查批准逮捕工作中，如果发现公安机关的侦查活动有违法情况，应当通知公安机关予以纠正，公安机关应当将纠正情况通知人民检察院。
