法律的原则

Since the current system of intellectual property law is still not perfect,conflicts in the field of intellectual property rights are objective phenomena.Based on the principle of "first rights protection",some problems still exist in the settlement of that issue.Theoretically,it is contrary to the purposes of intellectual property system.

知识产权领域的权利冲突现象是客观存在的，由于目前的知识产权法律体系不够完善，司法界在解决这一问题时所依据的"保护在先权利"原则仍存在一些问题，这在理论上有违知识产权制度的宗旨，在司法实践中也不利于保护相关利益主体的合法权益。

Our legislation in this field seems to be weak, such as a few regulation, less protection on consumers and lack of strict punishment on liability bearer, so we have to, with the reference of reasonable rules from different states, perfect the legislation in this field.
