在2010年世博会召开前夕，我们作为新世纪的小学生，更要提高自身的法律意识，自觉学习基本的法律知识，逐步培养法律素质，成为一个遵纪守法的好公民；我们要善于运用法律保护自己的合法权益不受侵犯，自觉不损害他人和社会的利益；我们要热心宣传法律法规，以正确的法制观念去影响身边的人，带动周围的人，为构建社会主义和谐社会做出应有的贡献。

The author mainly presents his ideas in this thesis from the following aspects: To perfect Chinese sports law, China should have its own sports arbitration system so that the law could catch up with the development of Chinese sports and international sports as well; Sports arbitration should aim at fairness and effectiveness; The popularity of sports arbitration institutions and the lawfulness of arbitration procedures and verdict effect make sports arbitration quasi-judicial; As long as sports arbitration is listed in the regulations of sports organizations, it could be applied for its compulsiveness; Sports arbitration is supposed to address the disputes caused by the disciplinary punishment, and that caused by the such major problems like the registration, circulation, and qualifications of the sportsman, and disputes caused by the contracts in sports activities; Mediation procedure and immediate arbitration procedure should be given special attention in the establishment of arbitration procedures; Sports arbitrators should be neutral in solving disputes, and should be a qualified sports worker.

本文认为，为完善中国体育法制建设，适应中国竞技体育发展的实际需求并与国际惯例接轨，中国应尽快设立体育仲裁制度；体育仲裁的价值目标应该是公正和效益；体育仲裁机构的民间性及仲裁程序和裁决效力的司法性，使得体育仲裁的性质具有准司法性；体育仲裁具有强制性的特征，只要体育组织的章程中有体育仲裁的规定，即可申请体育仲裁；体育仲裁的范围应限于竞技体育领域中因体育组织的纪律处罚所引起的纠纷，因运动员注册、流动、转会以及参赛资格等体育专业问题所引起的纠纷，因竞技体育活动中的合同关系所引起的纠纷。体育仲裁的程序建构要突出调解程序和快速仲裁程序；体育仲裁员必须确保中立并且其素质群中还应具备体育知识的素质。

But it is workable in terms of moral and medical ethics, as jurisprudence, and it can help us to improve the construction of the legal institutions , perfect the law system for protecting lives and enlarge the strength for life protection,so it is necessary and meaningful in practice.

但无论从安乐死的道德伦理的角度，安乐死的医学伦理的角度，还是从安乐死的法理学分析看，安乐死立法，对于健全我国的法制建设，完善对生命保护的法律体系，加大对生命的保护力度，不但具有理论上的必要性，也具有积极的现实意义。

The results show that the porosity of the membrane prepared by ScCO_2 induced phase separation is higher than that prepared by conventional method;the membrane structures are significantly influenced by the process parameters;compared with the conventional immersion precipitation phase inversion,ScCO_2 induced phase separation process can effectively avoid the formation of macrovoids at suitable operating conditions;during depressurization process,the great differences in the effect of depressurization time on membranes structure for various polymer materials result from that the speed of CO_2 gaseous nuclei escaping from membrane substrate can not keep the pace with the outer depressurization rate.(2) The tendency that the interaction parameters affect the binodal curve position is illustrated by changing the interaction parameters in reasonable ranges.

研究结果表明：与传统方法相比，采用ScCO_2诱导相转化法可获得更高的膜孔隙率；通过改变操作参数可对膜的结构进行调控，且操作参数对膜结构的影响与铸膜体系的自身性质也紧密相关；在适宜的操作条件下，ScCO_2诱导相转化法能有效避免采用传统的浸入沉淀相转化法制膜时易出现的大空腔结构；泄压过程中CO_2气核从聚合物膜基体中逃逸的速度能否与膜基体外部的泄压速度保持同步，是泄压时间对不同材质膜结构影响截然不同的根源所在。

Based on the background of China's new tax refund policy for export carries into being, this article is mainly to analyze the reform contents. And than according to the new policy's performances and influences in recent years, this paper finds some problems existing in it, aims at which some corresponding measures that especially on the share mechanism of the tax refund policy for export and its jurally standardization would be proposed on .By this way, the author hopes those suggestions would be useful to make our country's new tax refund for export works much sounder as well as promoting the innovation of China's foreign trade.

本文主要是从我国新出口退税政策所发生的经济背景和前提出发，对改革的主要内容进行分析，根据近两年来我国新出口退税政策实施的状况，及其对我国的经济所产生的一定影响，发现现阶段我国出口退税政策所出现的在管理体制和结构上的一些问题，并针对这些问题，提出我国的出口退税政策应该在出口退税的分担机制以及法制规范化等方面不断完善的几项具体建议，不断促进我国的外贸体制改革。

For this reason, some basic studies, such as the definition of the environment, systematic analyses of the ecosystem of man-environment, deep thinking about environmental problems, navigative proposal of environmental construction, assessment of environmental awareness and ethics, comments on importance of morals and laws, philosophical ponderation of environmental values, and discussion on relationships between science, technology and the environment are previously conducted in the dissertation.

为此目的，本文首先通过对环境的基本概念的界定、人类-环境系统的层次分析、环境问题的理性透视、环境意识与生态伦理、环境价值的哲学思考、科学技术与环境、从环境保护到环境恢复再到环境建设等方面的讨论，向读者介绍了自己对环境的若干思想和认识，这也为之后的研究作了必要的铺垫。在上述讨论中，尤以经济与社会的层次分析、环境保护与环境恢复和环境建设战略辨析、环境道德与环境法制及环境价值的哲学反思等方面的论述最能体现作者独到的见解与理性。

At last, the article indicates that there are some problems in capital management and put forward that we should improve capital management on nine facets we should change the role of government in capital management perfect law system environment of capital management , emphasis on internal recombination of enterprise , strengthen daytimeaudit and supervise in capital management to avoid profit package, strengthen adjustment of the right of assets , strengthen the role of invest bank in capital management , pay attention to recombination of immateriality assets ,emphasis on imagine package in the recombination enterprise ,call the ability of entrepreneur and so on to perfect capital management and solve some problems which enterprise confronts (1) solve the problem of poor enterprise (2) solve the problem of prepotent enterprise expansion (3) solve the problem of irrational form of recoinbinatiori enterprise (4)solve the problem of single right structure of enterprise (5)solve the problem of irrational asset collocation to induce bad effect (6)solve the problem of lack increment in development of enterprise (7)solve the problem of irrational structure so we induce enterprise to coruscate flesh vigor continually,and stock market will develop and boom continually.

最后提出了资本经营中存在的一些问题，提出要从九个方面着手改进资本经营，通过对政府在资本经营中角色的转换、健全和完善资本经营的法制环境、加强企业内部的重组、加强资本经营的审计与监督、防止利润包装、加强产权结构的调整、加强投资银行在资本经营中的作用、重视无形资产的重组、加强重组企业的形象包装和呼唤企业家才能等方面改善资本经营，解决企业经营所面临的一些问题：（1）解决劣势企业问题；（2）解决优势企业扩张问题；（3）解决企业重组形式不合理的问题；（4）解决企业产权结构一元化问题；（5）解决资源配置效益低下问题；（6）解决发展中增量不足的问题；（7）解决结构不合理的问题，这样才能使企业不断焕发出新的活力，证券市场才能不断繁荣发展。
