查封

Article 69 For the land use right that is seized or anticipatorily seized by the peoples court, during the period of seizure or anticipatory seizure, the alteration registration of land right or the registration of land mortgage right or easement may not be made.

第六十九条对被人民法院依法查封、预查封的土地使用权，在查封、预查封期间，不得办理土地权利的变更登记或者土地抵押权、地役权登记。

When a people's court seizes or freezes any properties of the person subject to enforcement during the course of enforcement according to Articles 221 and 223 of the Civil Procedure Law, no entity, including any other people's court, can repeatedly seize, freeze or illegally defreeze the said property, otherwise, the violator will be punished according to Article 102 of the Civil Procedure Law.

人民法院在执行中已依照民事诉讼法第二百二十一条、第二百二十三条的规定对被执行人的财产查封、冻结的，任何单位包括其他人民法院不得重复查封、冻结或者擅自解冻，违者按照民事诉讼法第一百零二条的规定处理。

In case of sealing up, distraint and freezing of property and causing damage or destruction to the property, compensation shall be paid according to the provisions of (3) and (4) of this Article

Article 28 Where the property rights of a citizen, legal person or other organization are infringed upon and damage is caused, it shall be dealt with according to the following provisions:(1) in case of imposition of a fine or penalty, recovery or confiscation of property, or expropriation of property and article, or appointment of expenses in violation of the provisions of the state, the property shall be returned;(2) in case of sealing up, distraint and freezing of property and causing damage or destruction to the property, compensation shall be paid according to the provisions of (3) and (4) of this Article;(3) in case of damage to the property which should be returned, the original state shall be restored if it can be done.

第二十八条侵犯公民，法人和其他组织的财产权造成损害的，按照下列规定处理：处罚款，罚金，追缴，没收财产或者违反国家规定征收财物，摊派费用的，返还财产；查封，扣押，冻结财产的，解除对财产的查封，扣押，冻结，造成财产损坏或者灭失的，依照本条第项的规定赔偿；，应当返还的财产损坏的，能够恢复原状的恢复原状，不能恢复原状的，按照损害程度给付相应的赔偿金；应当返还的财产灭失的，给付相应的赔偿金；财产已经拍卖的，给付拍卖所得的价款；吊销许可证和执照，责令停产停业的，赔偿停产停业期间必要的经常性费用开支；对财产权造成其他损害的，按照直接损失给予赔偿。

Interpleader: If any dispute arises as to any action to be taken by Escrow Agent, or to its rights and duties under this Agreement, or if it is in doubt as to such duties, or if any attachment, garnishment, or other similar proceeding is instituted or procured as to all or any part of the Escrowed Funds, and if any writ, order, or rule of attachment, garnishment, or other similar order is levied upon or entered against any portion of the Escrowed Funds, Escrow Agent shall have the right to: continue to hold the Escrowed Funds, or any part thereof, until such time as Seller/Developer and Buyer agree in writing to the disbursement thereof, in a form reasonably satisfactory to Escrow.

互相诉讼：如就监管人所采取的任何行为，或者其在本协议项下的权利义务发生争议，或者对该等义务存在疑问，或者就全部或部分监管资金发生任何查封、扣押或类似程序，以及如对全部或部分监管资金发出任何令状、命令、或查封令、扣押令、或其他类似命令，则监管人有权：继续持有监管资金，或其任何部分，直至卖方/开发商和买方以令监管人满意的合理书面方式同意支付。

Article 66In impounding or sealing up the movables or immovables with a property right certificate in line with the provisions of Article 37, 38 or 40 of the Law on the Administration of Tax Collection, tax authorities may order the party involved to turn in the certificate for safekeeping and at the same time issue a notice of assistance for enforcement to the relevant department, which shall not handle ownership transfer formalities of the movables or immovables in the course of its being impounded or sealed up.

第六十六条税务机关执行税收征管法第三十七条、第三十八条、第四十条的规定，实施扣押、查封时，对有产权证件的动产或者不动产，税务机关可以责令当事人将产权证件交税务机关保管，同时可以向有关机关发出协助执行通知书，有关机关在扣押、查封期间不再办理该动产或者不动产的过户手续。

Property that has already been frozen shall not be distrained or frozen for a second time.

财产已被查封、冻结的，不得重复查封、冻结。

If properties have been sealed up, distrained or frozen, the restraints shall be lifted; for properties thus damaged or missing, compensation shall be paid in accordance with the provisions of Items 3 and 4 of this Article

查封、扣押、冻结财产的，解除对财产的查封、扣押、冻结，造成财产损坏或者灭失的，依照本条第、项的规定赔偿

Article 36 Where, after bankruptcy declaration, the bankrupt enterprise's properties are sealed up, distrained or frozen in other civil procedures, the people's court that accepts the bankruptcy case shall immediately notify the people's court that takes the measure of sealing up, distraining or freezing the properties to cancel the measure, and handle the transfer formalities to the people's court that accepts the bankruptcy case.

第三十六条破产宣告后，破产企业的财产在其他民事诉讼程序中被查封、扣押、冻结的，受理破产案件的人民法院应当立即通知采取查封、扣押、冻结措施的人民法院予以解除，并向受理破产案件的人民法院办理移交手续。
