存在不公平负面影响、问题难以理解、或者误导陪审团的危险，或者考虑到不当拖延、浪费时间、或者不必要地提供累积证据等因素，并且上述危险或考虑远远超过/压倒证据的证明价值的，证据即使具有相关性，也可以排除。
