本文首先针对国有土地招标这一出让方式的演进和发展，结合土地特殊的供求关系，根据土地招标出让方式的交易程序及特点，分析了土地招标这一方式逐步被采用的原因，同时从三个方面揭示了这一方式在应用的过程中存在的种种问题，一是在制度方面表现出来的问题，二是在招标流程方面表现出来的问题，三是存在一些非市场化的不正当行为问题。
