损失赔偿

Article 28 Where the property rights of a citizen, legal person or other organization are infringed upon and damage is caused, it shall be dealt with according to the following provisions:(1) in case of imposition of a fine or penalty, recovery or confiscation of property, or expropriation of property and article, or appointment of expenses in violation of the provisions of the state, the property shall be returned;(2) in case of sealing up, distraint and freezing of property and causing damage or destruction to the property, compensation shall be paid according to the provisions of (3) and (4) of this Article;(3) in case of damage to the property which should be returned, the original state shall be restored if it can be done.

第二十八条侵犯公民，法人和其他组织的财产权造成损害的，按照下列规定处理：处罚款，罚金，追缴，没收财产或者违反国家规定征收财物，摊派费用的，返还财产；查封，扣押，冻结财产的，解除对财产的查封，扣押，冻结，造成财产损坏或者灭失的，依照本条第项的规定赔偿；，应当返还的财产损坏的，能够恢复原状的恢复原状，不能恢复原状的，按照损害程度给付相应的赔偿金；应当返还的财产灭失的，给付相应的赔偿金；财产已经拍卖的，给付拍卖所得的价款；吊销许可证和执照，责令停产停业的，赔偿停产停业期间必要的经常性费用开支；对财产权造成其他损害的，按照直接损失给予赔偿。

China's General Principles of Civil Law and judicial interpretations have covered part of the economic loss compensation rules,the Tort Lability Act in future should follow the established tradition,at the same time should stipulate the compensation rule of pure economic loss that arecaused by a third party tort and false claims.

我国民法通则和一些司法解释已经涵盖了对部分纯粹经济损失的赔偿规则，未来的侵权责任法应当遵循既有传统，同时对第三人侵害债权及虚假陈述造成的纯粹经济损失之赔偿规则作出规定。

If we are entitled to claim damages for nonperformance or for the failure of the supplier to remedy the defects despite having been set a corresponding deadline,lumpsum damages in an amount of 30% of the gross invoice amount shall be due and payable or ,in the case of a claim for compensation for loss due to delay,the damages due and payable shall amount to 3% per week or part of a week up to max .30% of the gross invoice amount.

In compensating for loss of or damage to the insured property, the Insurer shall deduct from the amount of compensation the salvage value of such property and the amount recovered by the Insured from third parties.

Based on the concept and theory of liability without fault, this article discusses the 76th statute in the Law of On-road Traffic Safety, which says that the liability without fault gauge will be applicable if there is an accident between motor vehicle and a non-motor vehicle or pedestrians. It also elaborates the significance of the principle of applying the liability without fault in traffic accident cases. It means that besides intentionally, the non-motor vehicle driver or pedestrians don't have to pay the loss of the side of motor vehicle, even though there is a severe mistake by non-motor vehicle driver or pedestrians. This conclusion disaffirms that the damaged motor vehicle may claim for compensation to the non-motor vehicle driver or pedestrians.

本文从无过错责任概念及其理论依据入手，论述了《道路交通安全法》第七十六条规定的机动车与非机动车驾驶人、行人之间发生交通事故实行无过错责任归责原则，并详细阐释了在交通事故损害赔偿中适用无过错责任原则的功能，从而得出了机动车与非机动车驾驶人、行人之间发生交通事故，非机动车驾驶人、行人除故意外，即使存在重大过错，也不应当对机动车一方的损失承担赔偿责任的结论，否定了有损失的机动车一方可以向非机动车驾驶人或者行人索赔的观点。

At last, we analyzed the responsibility form in law of infracting the right of goodwill and the suited rule of it. And analyzed the character of the suited rule of the hurt and atonement responsibility, i.e. we must pay attention to the lost of goodwill as an intangible assets. We also give the way to calculate the lost of goodwill.

最后分析了侵害商誉权的法律责任方式及法律责任的具体适用规则，着重分析了损害赔偿责任适用上的特点，即应兼顾对商誉作为无形财产的损失的赔偿，还分析了商誉损失的计算方法。

83Provided always that the Insurer has previously admitted liability under this Policy, any claimant under this Policy shall, at the expense of the Insurer do, and concur in doing and permit to be done all such acts and things as may be reasonably required by the Insurer for the purpose of enforcing any rights and remedies, or of obtaining relief or indemnity from other parties to which the Insurer shall be or would become entitled or subrogated, upon its paying for or making good any loss or damage under this Policy, whether such acts and things shall be or become necessary or required before or after his indemnification by the Insurer
