承包人

If the Contract does not contain any rates or prices applicable to the varied work, the rates and prices in the Contract shall be used as the basie for valuation so far as may be reasonable, failing which, after due consultation by the Engineer with the Employer and the Contractor, suitable rates or prices shall be agreed upon between the Engineer and the Contractor.

如果合同中未包括可适用于变更后工程的单价或价格，则合同中单价及价格只要合理，也可作为估价的基础，如果不适用，在与承包人及业主协商后，由工程师与承包人商定一个合适的单价或价格。

The Contractor shall then be paid for such varied work under the terms set out in the daywork schedule included in the Contract and at the rates and prices affixed thereto be him in the Tender.

Variations 52.3 Exceeding 15 Percent If, on the issue of the Taking-Over Certificate for the whole of the Works, it is found that as a result of: all varied work valued under Sub-Clause 52.1 and 52.2, and all adjustments upon measurement of the estimated quantities set out in the Bill of Quantities, excluding Provisional Sums, daywork and adjustments of price made under Clause 70, But not from any other cause, there have been additions to or deductions from the Contract Price which taken together are in excess of 15 per cent of the "Effective Contract Price"(which for the purposes of this Sub-Clause shall mean the Contract Price excluding Provisional Sums, and allowance for dayworks, if any) then and in such event (subject to Any action already taken under any other Sub-Clause of this Clause), after due consultation by the Engineer with the Employer and the Contractor, there shall be added to or deducted from the Contract Price such further further sum as may be agreed between the Contractor and the Engineer or, failing agreement, determined by the Engineer having regard to the Contractor's Site and general overhead costs of the Contract.

At end of each mouth the Contractor shall deliver to the Engineer a priced statement of the labour, materials and the Contractor's Equipment, except as aforesaid, used and the Contractor shall be not entitled to any payment unless such lists and statements have been fully and punctually rendered. Provided always that if the Engineer considers that for any reason the sending of such lists or statements by the Contractor, in accordance with the foregoing provision, was impracticable he shall nevertheless be entitled to authorize payment for such work, either as daywork, on being satisfied as to the time employed and the labour, materials and Contractor's Equipment used on such work, or at such value therefore as shall, in his opinion, be fair and reasonable.

The reasonable cost of removal of Constructional Plant under sub-clause（7）of this Clause and,if required by the Contractor,return thereof the Contractor's main plant yard in his country of registration or to other destination,at no greater cost.

本条第7款所规定的搬迁建筑设备的合理费用，如果承包人要求，包括将此设备运回到承包人注册国的主要设备堆置场的费用，或运至其他地点的费用，但此费用不得超过运回注册国的费用。

EThe reasonable cost of removal of Constructional Plant under sub-clause (7) of this Clause and, if required by the Contractor, return thereof the Contractor's main plant yard in his country of registration or to other destination, at no greater cost.

The Contractor is responsible to sell all products produced by the Contractor in the Principal's name, the sales price shall be calculated based on local market price or evaluation price, and subject to the Contractor's acknow

Unless within fourteen days of the receipt of such notice the Engineer shall by counternotice direct that such protection or strengthening is unnecessary , then the Contractor will carry out such proposals or any modification thereof that the Engineer shall require and , unless there is an item or are items in the Bill of Quantities for pricing by the Contractor of the necessary works for the protection or strengthening aforesaid , the costs thereof shall be paid by the Employer to the Contractor .

除非在接到通知14天内，工程师以取消通知的方式指示不必采取此种保护或加固措施，承包人将施行此种方案或施行经工程师要求修改后的方案，除非建筑工程清单中含有一项或多项已由承包人标价的上述公路或桥梁保护或加固的必要项目，其费用得由业主向承包人支付。
