But,because this right blurs the function of the prosecutor and the judge,violates the principle of separating prosecute and adjudicature,ruins the neutrality of judges,harms the equality of judgments,makes mass in beth procedure theories and judicial practice.Therefore,it is desirable to eliminate the judge's right to investigate outside the court,and accordingly,measures should be taken to meet this requirement.
