First of all, we focus on social cerebration development, diversified and abundant educational model transfer, comprehension of form background of school-based management.

本文旨在进行国民小学实施学校本位管理之研究，首先探究社会思想发展、多元丰富的教育典范转移，了解学校本位管理的形成背景，进而阐述学校本位管理的意义与精神、理论基础，从而归纳出学校本位管理的精神概念，最后以实施内容、参与成员的角色任务，厘定社区家长、老师、校长、教育行政机关的权责。

五、学校类别、担任校长的年资、性别、学校区域等背景变项，在校长工作选择量表的得分有差异情形存在。

Results About 80.4% of the investigated schools, in which the principals took main responsibility of cafeteria regarding to hygiene and health issue; 90.2% of the investigated schools held the hygiene licences; 45.9% schools had unclean surroundings, and 52.5% lacked required sanitary equipment; 41.0% mixed uncooked foods, semimanufactured foods and cooked foods together.

结果 80.4%的学校实行食品卫生校长负责制，90.2%的学校持有有效卫生许可证；45.9%的学校食堂内外环境不整洁，52.5%的学校无有效"三防"设施；41.0 %的学校没有做到生食、半成品及熟食分开存放。

Finally, measures and suggestions for solution were proposed aiming at these problems of secondary and primary school teachers in Wuchuan county . 1. Reform of the personnel distribution system and whole staff engagement system should be performed as soon as possible 2. System of selection of high and elementary schoolmasters should be reformed, perfecting schoolmaster responsibility system, reducing organization refinedly, compressing non-teaching personnel proportion, improving administration level of school. 3. Taking powerful measures to stabilize high and elementary school teacher"s team. 4. Executing "the Excellent Teacher Project of Century" to train all teachers, building teachers training mode according to current county"s practices and school"s characteristics to improve teachers" quality. 5. Increasing the adjustment for deployment and optimizing teachers resource configuration to improve the quality of elementary education. 6. Introducing talents actively and strengthening high school teacher team"s construction to satisfy the needs of the development of high school education.7. Strengthening teachers" moral education to improve teachers professional moral level.

最后，针对武川县中小学教师队伍中存在的这些问题，提出了解决的对策与建议：加快人事分配制度改革，全面推行教职工全员聘用制；改革中小学校长选拔任用制度，进一步完善&校长负责制&，精简机构，压缩非教学人员比例，提高学校的管理水平；切实采取各种有力措施，稳定中小学教师队伍；实施&跨世纪园丁&工程，进行全员教师培训，建立符合本县实际和学校特色的教师培训模式，提高教师队伍的整体素质；加大布局调整力度，优化教师资源配置，提高基础教育的质量；积极引进人才，加强高中教师队伍建设，以满足高中教育发展的需求；加强师德教育，提高教师的职业道德水平。

In order to solve these problems about juridical person system of private school in China, the paper offers several countermeasures. According to setting up school corporation in legal qualification in Japanese private school, we should properly revise our present educational law and add special items and regulations about setting up school corporation; we also should revise some statutes and items restricting juridical person's capacity for fund-raising and financing, adjust some policies and rules which are bad to funds raising. At the same time we need introduce the experiences of school corporate fathering system of private school in Taiwan and especially in Japan. To set up staff selecting mechanism about corporate organ in private school, to reform management patterns and perfect organizing mechanism of corporate organ in non-profit private school, to carve up the rights borderline between the council and principal, we could establish the reasonable and normative corporate management system of private school in the future.

为解决我国民办学校法人制度的现存问题，论文提出了相应的具体对策：借鉴日本在教育领域对私立学校的法律主体资格专设&学校法人&的经验和做法，适当修改我国现行的教育法律，增加设立&学校法人&的专门条款及其相关内容规定；修改制约民办学校法人主体筹资融资能力的一些法律法规条款，调整不利于民办学校筹措资金的诸多政策规章限制；在借鉴台湾地区、尤其是日本私立学校有关学校法人治理制度的经验基础之上，增加有关民办学校法人机关组成人员的来源和遴选机制，改革和完善目前我国民办学校尤其是从事非营利活动的民办学校的法人机关运作机制，合理划分校董事会与校长的权限，从而确立起完善和规范的民办学校的法人治理制度。
