This article first analyses the drawbacks in the pattern of collective land ownership in China's rural areas regarding to its subject, object, rights and management, and then proposes some constructive suggestions.

本文试图从农村集体土地所有权的主体、客体、权能以及管理的现状，分析我国现行农村土地所有权存在的问题，并同时提出自己的一些完善见解和建议，以期能对完善我国集体土地所有权制度有所助益。

The results indicate that,（1） the current ownership of rural land is integrated by the state and private ownerships, i.e., a special pattern of mixed ownership;（2） agricultural economy has shown the characteristics of modern agriculture, so it is no longer totally small-scale farming economy;（3） privatization has two meanings, i.e., there is no privatization in terms of ownership, however, it is a privatization process in terms of management.

研究结果：（1）现行农村土地制度是一种具有公私相互融合性质和特点的所有制类型，是一种特殊的混合所有制模式；（2）农业经济已经具有了现代农业的许多特点，不完全是小农经济；（3）私有化有一般与特殊两种含义，包括土地流转在内的土地制度变革不存在所有权意义上的私有化，但从经营权看是私有化过程。
