Article 16 Where a land user that has obtained the right to use state-owned land through agreement-based assignment needs to change the purpose of land use stipulated in the assignment contract to business purposes, such as commerce, tourism, entertainment and commodity residence, etc., that user shall obtain the consent of the assigner and the department of urban planning of the people's government of the city or county, conclude the agreement on alteration of the contract on assignment of land use right or conclude a new contract on assignment of land use right, make up the corresponding assignment fee for land use right at the price on the land market at the time of alteration according to the changed purpose of land use, and make the alteration registration of land use right according to law.

第十六条以协议出让方式取得国有土地使用权的土地使用者，需要将土地使用权出让合同约定的土地用途改变为商业、旅游、娱乐和商品住宅等经营性用途的，应当取得出让方和市、县人民政府城市规划部门的同意，签订土地使用权出让合同变更协议或者重新签订土地使用权出让合同，按变更后的土地用途，以变更时的土地市场价格补交相应的土地使用权出让金，并依法办理土地使用权变更登记手续。

土地公有制与私法理念的差异使我国的物权立法遇到前所未有的挑战，国家土地所有权集民事主体与行政主体于一身，便于政府对土地利用行为进行积极的干预以确保土地的可持续利用，但也可能因为过分的干预而影响土地的利用效率，干预的形式主要应该是对土地规划的严格执行。在社会主义市场经济条件下，与发达国家相比，我国的土地权利体系中缺乏土地下级所有权这样一个中间环节，影响了土地的利用效率。

Based on connotation of intensive land use and the evaluation principle of intensive deployment of city land,this paper establishes a set of scientific and practical index system in evaluating the intensive utilization of city land,and conducts a demonstration analysis in 13 cities of Jiangsu Province by the way of multifactor comprehensive evaluation,rank correlation coefficient and cluster analysis.During the last ten years from 1997 to 2006,the urban land use intensity had increased in all cites,but varied in amplitude and mode in different cities.Urban land use intensity was descending sharply from the southern and the middle to the northern part of Jiangsu Province,in which Nanjing was the tiptop and Suqian was the lowest .

从城市土地集约利用的内涵入手，依据城市土地集约利用评价的原则，从土地利用投入水平、土地利用程度、土地利用效率、土地利用生态环境质量等方面构建了一个具有三级层次结构的城市土地集约利用度评价的指标体系，并在此基础上采用多因素综合评价，秩相关系数和聚类分析的方法以江苏省13个地级市为例进行了实证分析，结果表明：（1）1997～2006年，江苏省13城市土地利用集约度都得到了提高，但是提高的幅度和方式不同；（2）不同城市，苏南、苏中和苏北之间城市土地利用集约度呈现出明显的城市和地域差异，其中，省会南京最高，苏北的宿迁最低。

On the base of the advanced theories, research methods from home and abroad, intensive use of urban land on the connotation and extension have been defined, also the driving factors of intensive use land in Xinjiang have been analyzed. As the case of nineteen cities of the Xinjiang Uygur Autonomous Region, from the land input level, the extent of land use, land-use efficiency and land use in four areas of eco-environmental quality, the establishment of a level of intensive use of urban land evaluation system has been done in this ***. Using the methods of Principal component analysis, Spearman rank correlation coefficient and ArcGIS, calculate the principal city of the intensive use of urban land points between 2001-2006, the municipalities of urban Land Use Composite Index, build the three-dimensional display model of Intensive use level of urban land, then analyses the characteristics of spatial-temporal variance of the urban land intensively utilization. Finally, analysis propose measures and advices.

本文反在呼取海外外相闭实际和研讨方式的基本上，闭于城市土地集约当用的外涵及外延入行了界订，并闭于旧疆土地集约当用的驱动果荤入行了剖析，然后以旧疆19个从要城市为研讨区域，自土地投入火平、土地当用火平、土地当用效力和土地当用生态环境量量四个方里，树立了城市土地集约当用火平评价指本体解，采取从败开剖析法闭于旧疆2001—2006暮年城市土地集约当用火平入行了评价，盘算各从要市的城市土地集约当用得开，用秩相闭解数闭于所盘算出的各市的城市土地集约当用综开得开入行时光特征剖析；还帮ArcGIS软件，剖析旧疆城市土地集约当用火平的空间格局；自城市非工业己口、投入、产出取用地删加弹性三个方里剖析城市土地分体集约当用收铺趋背；最初降出了土地集约当用的闭于策建议。

The government-oriented land reserve model has achieved some good results, but it is still going under way and some problems do exist, which can be listed as follows: 1 The legal rights of the people whose land has been purchased may be infringed upon because of the government's monopoly over the land purchase price; 2 Aimed at increasing land remise income, the local government reduces land supply for the purpose of raising land price, which arouses people's suspicion upon land reserve system. 3 The government-oriented land reserve model needs large funds and it is difficult to meet the demand for funds mainly by bank loans, which results in more risks in the operation of land reserse funds.

在肯定成效的同时，还应看到政府主导型土地储备模式还处在发展初期，实际工作中也遇到了一些问题：一是要求所有进入城市流转的土地必须由政府统一收购，容易引起地方政府利用垄断权利，压低土地收购价格，侵犯土地被收购者的合法权益；二是政府牢牢掌握城市土地供应的主动权，一切土地经由政府垄断供应，但由于土地供应与地方财政收入密切相关，为增加土地出让收益，地方政府采用"饥饿供地法"来达到提高土地价格的目的，引起了人们对土地储备制度的怀疑；三是政府主导型土地储备模式需要巨额资金加以支持，但以银行贷款为主的融资方式难以满足其资金需求，增加了土地储备资金运行的风险。

ABSTRACT: Based on analyzing the urban land supply mechanism in our country, this paper discusses the stability and controllability of the model, and gets some related suggestions aiming at urban land supply control thereinafter.

针对我国城市土地供给机制，建立了城市土地供给的控制模型，对该模型的稳定性和输出可控性进行了分析和讨论，并针对城市土地供给调控提出了相关建议：城市土地供给可以通过调整直接出让土地、储备土地以及收回土地来调控；城市土地规模扩张控制的关键在于对城郊土地征用的控制；城市土地供给计划的制订不仅要考虑前期土地供给对本期土地供给的影响，也要考虑本期土地供给对后期土地供给的影响。

三二城市土地优化配置基础上的土地收购储备运行模式针对我国目前土地收购储备运行模式存在的问题，结合城市土地利用特点，基于城市士地优化配罩、城市总体规划、土地利用总体规划制定的规划期内土地总需求量、年度用地规模以及具体的用地布局，结合社会经济发展、城市化进程，编制土地收购、储备计划，并根据不同土地收购对象、性质，应用相应技术方法评估其土地收购价格，建立一套符合我国国情的土地收购、整理、储备运行模式。
