METHODS: 5 184 people of non-manual workers and manual workers in city as well as farmers at different sex, aged from 20-59 years, were selected in Shijiazhuang, Cangzhou and Chengde with random sampling of stratified cluster in July 2000. They were assigned into 20-39 year group and 40-59 years group according to age to perform investigation of their physical work, which composed of strength of grasp, anteflexion of body when sitting, standing with single foot when closing eyes, back pressure, vertical jump, 10 m×4 return run, push-up, sit-up and choice of reaction time, etc. RESULTS: 4 800 people were involved in the result analysis.

于2000-07用分层整群的随机抽样方法抽取石家庄、沧州、承德3个城市不同性别的城市非体力劳动者、城市体力劳动者、农民3类职业人群的20～59岁公民5184名，按年龄分为20～39岁组和40～59岁组两组，对其进行体能测查，测查内容包括握力、坐位体前屈、闭眼单脚站立、背力、纵跳、10m×4往返跑、俯卧撑、仰卧起坐、选择反应时等。

Responding to the questions of the laborer's rights in our current corporate separation and taking account of the corporate self-government principle, the author suggests that we should establish inheriting system of labor contract, indemnity system for canceling the labor contract, priority of continuing to employ system, corporate social responsibility system and internal employee stock ownership system to fill the legal empty of the protection of laborer's violative rights in corporate separation in our labor law.

笔者针对我国现阶段公司分立中所涉及的劳动者权利问题，在兼顾公司自治权利的原则下，建议在我国现行法律法规中确立劳动合同承继制度、劳动者解除合同经济补偿金制度、公司分立时的优先留用制度、公司社会责任制度和内部职工持股制度，以填补我国劳动法在保护公司分立中劳动者权利受到侵害时请求保护其正当权利的法律空白。

Where a worker rescinds the labor contract in accordance with Item (2) of Article 35 of the present Provisions, the employer shall, on the basis of the worker's continuous term of work in the entity, pay economic compensations to the worker equal to 1 month's wages for each year he has worked, and the portion less than 1 year shall be calculated as 1 year.

劳动者依据本规定第三十五条第项规定解除劳动合同的，用人单位应当按照劳动者在本单位连续工作年限，每满1年发给劳动者1个月工资的经济补偿金，工作年限不满1年的按照1年计算。

Where a worker rescinds the labor contract in accordance with Item (2) of Article 35 of the present Provisions, the employer shall, on the basis of the workers continuous term of work in the entity, pay economic compensations to the worker equal to 1 months wages for each year he has worked, and the portion less than 1 year shall be calculated as 1 year.

劳动者依据本规定第三十五条第项规定解除劳动合同的，用人单位应当按照劳动者在本单位连续工作年限，每满1年发给劳动者1个月工资的经济补偿金，工作年限不满1年的按照1年计算。

Where a working entity terminates or rescinds the labor contract with an employee, the working entity shall pay off the wages of the employee once for all after having handled formalities with the employee.
