This article carries out a rational and sober analysis on the limitation of "High Salary for Clean Government" institution. As high salary institution does not effect the scarcity and dissimilation of power, it cannot fundamentally inhibit selfish nature of humanism, but it is a negotiation or compromise with selfish nature, so it is not a heal-all prescription in anti-corruption field, it has its own limitation.

本文还对高薪养廉制度的局限性进行了理性而清醒的分析，由于高薪养廉制度对权力的稀缺性和权力的异化没有影响力，它也不是从根本上抑制人类的私本质本身，而是与私本质妥协的结果，所以它在反腐败上是具有不彻底性的，这种不彻底性也导致了它的局限性。

On the basis of it, eight suggestions are put forward to evaluate the forestry ecological benefits:(1) it is an inevitable trend to carry out the comprehensive evaluation of the multifold forest ecological benefits;(2) upbuilding the theoretical frame of ecological benefits according to the situation of our country;(3) conducting the subarea case research based on the way of creativity accountment;(4) to set up the locating monitoring system of subarea forestry ecology profits to provide the reliable reference for the research;(5) studying the measuring estimate index more comprehensively to make it more self_contained and self_governed;(6) establishing the standards of the forest ecological benefit evaluation so that the evaluation could provide rational evidence for the establishment of the forestry compensation law and so on;(7) upbuilding economic accountment system of forest ecological benefits;(8) establishing economic compensation system of forest ecological benefits.

并且在此基础上提出了对今后森林生态效益评价研究的八点建议：(1)进行森林多种生态效益的综合评价是今后发展的必然趋势；(2)从国情出发建立我国森林生态效益评价理论框架；(3)在创新核算方法的基础上开展分区案例研究；(4)建立区域性森林生态效益定位监测系统，为研究提供真实可靠的数据资料；(5)更全面地研究生态效益计量评价指标，使之既具完备性又具独立性；(6)建立森林生态效益评价标准，使评价结果能为林业补偿等法律政策制定提供科学的依据；(7)建立森林生态效益经济核算制度；(8)建立森林生态效益的经济补偿制度。

Finally, the legal mechanism of Prior Consent is a new strategy that Brazil proposed for the purpose of protecting the public health, which divides the examination of patent applications for pharmaceutical products and processes between two federal agencies, National Institute of Intellectual Property and National Sanitary Supervision Agency. ANVISA has the obligation to render the final decision, granting or denying a patent.

其中前四种措施是国际社会上一直以来倡导的主要措施，后三种是新的解决公共健康危机的法律措施，其创新点在于：第一，呼吁将禁止反向支付纳入法律，并与BOLAR例外相结合使用，促进仿制药品的尽快上市；第二，将公共健康、医药品专利以及传统知识和遗传资源的知识产权保护三者紧密相连，通过对传统知识和遗传资源予以知识产权保护来应对发达国家的医药品专利；第三，&事先同意&法律制度是巴西提出的一种旨在保护公共健康，应对医药专利的新的法律制度，该制度规定凡是涉及医药品专利的申请都必须经过国家知识产权局和国家公共卫生监督局的公共审查，并且国家公共卫生监督局有是否授予专利的最终决定权。

因此在借鉴各国公司立法经验的基础上，本文认为，要完善我国股东知情权制度首先应在我国公司法律制度中赋予股份有限公司股东查阅公司帐簿的权利，同时为防止股东滥用此项权利，应当对股东行使该权利时的正当目的、持股比例、持股时间以及行使程序上作出必要的限制；其次应当明确股东质询权以及行使权利的范围、程序，赋予股东在质询权受到侵害时的诉权，并对法院的裁判赋予强制执行的效力，即责令董事会必须限期对股东的质询作出充分说明。

Based on those analyses and conformed international and national economic condition in china and some intrinsic defects of target zone regime, author transform target zone exchange rate regime by dividing two layers and bring forward a new exchange rate regime: double-layer-monitor exchange rate regime, the new model have possessed two merits, one is that the new model make "hollymoon effect" of target zone recurrence,and the merit can alleviate the fluctuation of exchange market;another merit is that the new model is a self-regulation system, that is say, the model can avoid long-term misalignment of exchange rate, those merit have major significance for china economy sustainable development and Chinese financial system more perfection, in paper we also present some fiscal policy and money policy served as a foil to double-layer-monitor exchange rate regime in order to make it work well, at last, we conclude that the new model will be the prior selection of RMB exchange rate regime reform for a long time form now on, and it also can serve as the bridge of RMB exchange rate regime steering to one of bipolar—free float.

在这些分析的基础上，并考虑到当前中国所面临的国际国内经济环境，针对汇率目标区的一些固有缺陷，笔者又对汇率目标区模型进行了分层改造，提出了一个新的汇率机制模型：汇率目标区双层监控模型，该模型有两个主要优势，一是可以使&蜜月效应&得以重现，从而避免外汇市场的过度波动；二是该模型是一个自稳定系统，能够进行自我调整，使实际汇率同长期均衡汇率保持一致，从而避免实际汇率的长期错位。这些优点对于我国经济的可持续发展，对于我国金融的更加完善，有着十分重要的意义。为使汇率目标区双层监控模型良好运行，论文还就相应配套的财政政策、货币政策措施作了探讨。最后得出结论，按照汇率制度&并存继起&假说，今后很长一段时间内，汇率目标区双层监控模型都将是人民币汇率制度的合意选择，另外，它也可作为人民币汇率制度向独立浮动制过渡的桥梁。
