The division of age for criminal responsibility has dichotomy, trichotomy and quartation and our country adopts quartation, that is, age for absolutely no criminal responsibility, age for relatively criminal responsibility, age for completely criminal responsibility and age for leniently handled responsibility.

针对上述缺陷，笔者提出了完善建议，首先，把刑事责任年龄从14周岁降到13周岁，并规定了相应的处罚措施；其次，对刑法第17条第2款的规定进行了重构；第三，确立了刑事责任年龄上限，并对老年犯罪人的刑罚予以特殊的立法规定。
