The people's court shall, when adjudicating the persons who are directly in charge or the persons who are directly responsible for the offence with regard to the crime committed by the entity, meanwhile adjudicate the distrained and frozen smuggled goods or articles, illegal proceeds and the instruments for crime of smuggling that the criminal entity owns, and shall recover and confiscate them.

人民法院在对单位犯罪中直接负责的主管人员或者直接责任人员进行判决时，对于扣押、冻结的走私货物、物品、违法所得以及属于犯罪单位所有的走私犯罪工具，应当一并判决予以追缴、没收。
