Secondly, the legal status of labor and education and rehabilitation. What the system founds on is only the "quasi-law", it"s legal status is not clear and definite.

目前对其性质的认识尚不统一，在性质尚未有定论的情况下，这一制度存在的必要性令人怀疑：其次，劳动教养的法律地位问题，劳动教养的一系列规范性文件，仅仅是一个&准法律&、&准法规&，其法律地位是不明确的，不具有正当性，合法性。

There are two assumptions: one is that the governmental public management is dividable and the effective way of realizing governmental affairs is government purchase. And social organizations who act as the cooperator with the government will be taken as the main carriers of government projects. The other is that for the social organizations to participate in the governmental affairs they should reflect their advantages, get the support from the policy, the law and the system. And social organizations should play more import role by making their own capability more perfect.

本文有两个假设：政府公共管理是可以分割的，而实现政府事务的有效途径是政府采购，作为与政府形成合作关系的社会组织，将成为政府项目的主要承担者；社会组织参与政府事务，要有效体现其组织优势，应当获得政策、法律、制度等方面的支撑，在完善其自身能力建设的情况下，发挥更大作用。

首先对A公司生产现场管理现状进行了简要描述；其次结合约束理论，严格按照其思维流程对该公司的生产现场进行了分析，构建了该企业的当前现实树，并找出其瓶颈所在；通过构建冲突图，寻找解决冲突的注入，建立了公司改善的未来现实树；以未来现实树为引导，结合丰田生产方式的一系列现场改善工具，从改善员工工作环境，提高员工满意度，增加员工技能培训，建立一系列制度措施保证现场的秩序化等方面入手，构建了公司的转变树，并得到了良好的执行；最后根据案例的实际运行情况，结合笔者的自身体会，对企业应用约束理论和丰田生产方式改善生产现场的操作流程提出了自己的设想。
