除本条例另有规定外，凡汇票不获承兑或被拒付款而不能兑现，必须向发票人及每一背书人发出不能兑现之通知

"Where a dishonoured bill or note is authorized or required to be protested, and the services of a notary cannot be obtained at the place where the bill is dishonoured,"

不能兑现之汇票或本票，如获授权或必须作拒绝证书者，而在该票据不能兑现之地方难以觅得公证人

"Where a bill is dishonoured by non- acceptance and notice of dishonour is not given, the rights of a holder in due course subsequent to the omission shall not be prejudiced by the omission;"

如汇票因不获承兑而不能兑现，而又未有发出不能兑现之通知，则在此项遗漏以后成为适时执票人者之权利，不应因此项遗漏而受影响

"The duties of the holder with respect to presentment for acceptance or payment and the necessity for or sufficiency of a protest or notice of dishonour, are determined by the law of the place where the act is done or the bill is dishonoured;"

执票人之责任，例如作承兑或付款提示方面，及作拒绝证书或汇票不能兑现通知之必要或所办手续是否有效，均根据作出该等行为或汇票不能兑现所在地方之法律决定

Article 102 In case of a pledge of bills of exchange, chequeschecks, promissory notes, bonds, deposit certificates, warehouse receipts or bills of lading specifying a date for encashment or delivery of goods, where such date falls behind the term for performance of the obligation, the pledgee may only cash it or deliver the goods at the expiration of the date for encashment or delivery.

第一百零二条以载明兑现或者提货日期的汇票、支票、本票、债券、存款单、仓单、提单出质的，其兑现或者提货日期后于债务履行期的，质权人只能在兑现或者提货日期届满时兑现款项或者提取货物。
