信用证

The Buyer shall open, With a bank to be accepted by both the Buyer and the Seller, an irrevocable,intransferable and indivisible Letter of Credit at sight, allowing partial shipments and transshipment, in favor of the seller and negotiable against first presentation of the shipping documents to the Bank of China in China.

付款条件：买方应通过买卖双方同意的银行，开立以卖方为受益人的、不可撤销的、不可转让和不可分割的、允许分批装运和转船的即期信用证。该信用证凭装运单据在中国的中国银行见单议付。

Payment terms is L/C The Buyer should apply with the Holland bank for the Negotiable, Irrepealable, Restricted L/C payment by documents presented, Seller to be the Benificiary and Construction bank of China Hangzhou branch to be the Paying bank .

采用信用证：买方收到卖方交货通知[详见本合同条款11]，应在交货日前15～20天，由荷兰银行开出以卖方为受益人的与装运全金额相同的可转让的附单据的不可撤销的限制性议付信用证，议付行为中国建设银行杭州支行。

IF WE GIVE NOTICE OF REFUSAL OF DOCUMENTS PRESENTED UNDER THIS CREDIT WE SHALL HOWEVER RETAIN THE RIGHT TO ACCEPT A WAIVER OF DISCREPANCIES FORM THE APPLICANT AND SUBJECT TO SUCH WAIVER BEING ACCEPTABLE TO US, TO RELEASE DOCUMENTS AGAINST THAT WAIVER WITHOUT REFENCE TO THE PRESENTER PROVIDED THAT NO WRITTEN INSTRUCTIONS TO THE CONTRARY HAVE BEEN RECEIVED BY US FROM THE PRESENTER BEFORE THE RELEASE OF THE DOCUMENTS.

如我行发出拒绝接受已送交本信用证文件的通知，在该等放弃追究为我行接受的情况下，我行将保留权利接受信用证申请人放弃追究文件有不符点，并根据该放弃追究将文件发放而无需知会文件送交方，但规定在文件发放前本行必须是没有收到由文件送交方提出相反的书面指示。
