This thesis has carried on some new explorations and researches in following three aspects: A. researching the combination course between rites and penalty law, we focus on the juristic basis, the legislation and the judicative practice in Chinese ancient times, and then gave three-dimensional demonstrations; B. we draw our conclusion about the nature of the syncretism of rites and penalty through paying attention on the interactivity of rites and penalty, not only on the unilateralism of them; C. we discuss on the value orientation of the syncretism of rites and penalty by comparing rites with penalty, which was determined by rank, patriarchal clan system, ethicality and sociality.

本论文在以下三个方面进行了一些新的探索和认识：在探索礼刑结合的过程中力图从思想层面的法理认识、立法层面的法律规范和实践层面的司法活动三个方面的结合分析中，形成立体化的论述；在认识礼刑结合的本质上，强调&礼&与&刑&的互动性，而不拘泥于传统的儒家思想改造刑律的单向化描述；在认识礼刑结合的价值取向上，从&礼&与&刑&的异同出发，点破了礼刑结合的价值取向在于等级性、宗法性、伦理性和社会性。

Four factors together caused this:(1) the insistence of the anti Gnostic fathers, particularly Tertullian, that the faithful are those who believe "the faith" as stated in the "rule of faith", ie, the Creed;(2) the intellectualism of Clement and Origen, to whom pistis was just an inferior substitute for, and stepping stone to, gnosis of spiritual things;(3) the assimilation of biblical morality to Stoic moralism, an ethic not of grateful dependence but of resolute selfreliance;(4) the clothing of the biblical doctrine of communion with God in Neoplatonic dress, which made it appear as a mystical ascent to the supersensible achieved by aspiring love, having no link with the ordinary exercise of faith at all.

有4个因素共同造成了这一：（ 1 ）坚持战斗在反腐败的诺斯替父亲，尤其是戴尔都良，即忠诚，是那些相信&诚信为本&的声明，在&法治诚信&，即，信仰；（ 2 ）知识分子的克莱门特和渊源，向谁信实的只是一个劣质的替代品，并踏脚石，预后的精神的东西，（ 3 ）同化的圣经道德斯多葛道德主义，伦理不是感激的依赖，但坚决自立；服装的圣经教义与上帝在neoplatonic著装，这使得它似乎是一个神秘上升到supersensible实现抱负的爱，没有结合一般意义上的演练的信念都没有。

The writings of the middle period include Gorgias (a consideration of several ethical questions), Meno (a discussion of the nature of knowledge), the Apology (Socrates' defense of himself at his trial against the charges of atheism and corrupting Athenian youth), Crito (Socrates' defense of obedience to the laws of the state), Phaedo (the death scene of Socrates, in which he discusses the theory of Forms, the nature of the soul, and the question of immortality), the Symposium (Plato's outstanding dramatic achievement, which contains several speeches on beauty and love), the Republic (Plato's supreme philosophical achievement, which is a detailed discussion of the nature of justice).

And it is no good to the herity and development of our good traditions , and soial harmony too.

目前我国的住房保障体系还缺乏对这些东方传统伦理的重视与运用，这在一定程度上加剧了我国保障住房供求失衡，加剧了社会养老压力，也不利于我国优良传统的继承与发展，不利于社会和谐。

Surveys show that there is cognition deficiency and stereotypic distortion of social workers and community correction center among clients; social workers provide plenty of pertinent services, which meet the needs of clients and have gained positive comments; social workers receive good evaluation in professional ethics in general, but have something to do in informed consent.

调查结果发现：服务对象对社区矫正社工及社团存在一定的认知不足和认知偏差；社工为服务对象提供了丰富且有针对性的服务，这些服务满足了服务对象的多种需要，获得了较高的满意度；从总体上来说，社工在专业伦理方面做得非常好，但在知情同意方面尚有待加强。
