5 Before issuing, under Clause 92, any certificate, which includes any payment in respect of work done or goods, materials, Plant or services supplied by any nominated Subcontractor, the Engineer shall be entitled to demand from the Contractor reasonable proof that all payments, less retentions, included in previous certificates in respect of the works or goods, materials, Plant or services of such nominated Subcontractor have been paid or discharged by the Contractor.

6 In the event of the Employer entering into any agreement for the hire of Contractor's Equipment pursuant to Clause 88.5, all sums properly paid by the employer under the provisions of any such agreement and all costs incurred by him in entering into such agreement shall be deemed, for the purpose of Clause 95, to be part of the Cost of executing and completing the Works and the remedying of any defects therein.
