This article is mainly a discussion on the spiritual damage compensation for close relatives of victim under the situations of damage to right of life, damage to the right of health and damage to the right of personality of the dead, which is based on an introduction and comparison of the concerned foreign legal regulations and academic theories and in combination with the legal practice in China Wherefore the author put forwards his own ideas as following: first, Under the condition that there is a distance of time between injury and death, the close relatives of the dead shall inherit the right of claim for spiritual damage compensation of the dead for the suffering before his death, in addition to their own intrinsic right of claim for spiritual damage compensation; The second, under the condition that the inflictor has caused the disablement of the sufferer or serious damage to his health, the close relative in a limited cycle of the sufferer should be granted with the right of claim for spiritual damage compensation, which is confirmed in law and becomes a practice in foreign countries; The third, since the aim of the law to protect the personality of the dead from infringement is to protect the benefits of the close relatives of the dead and to maintain public benefits, is constituted on the personality of the dead the close relative of the dead may initial legal proceeding for spiritual damage compensation.

探讨以介绍和比较国外相关法律规定和学术理论为前提，结合我国的实际情况，从理论与实践相结合的角度对以上各问题分别进行了分析，并提出了作者自己的一些见解：第一、在公民从受伤害到死亡有一段时间距离的情形下，死者的近亲属除依法享有其固有的精神损害赔偿请求权以外，还可以继承死者生前就其所受之精神损害而享有的精神损害赔偿请求权；第二、在加害人的行为已造成直接受害人残疾，或者是造成其健康严重受损的其他后果的情形下，我国应在借鉴国外已有立法和判例的基础上，赋予一定范围内的受害人近亲属以精神损害赔偿请求权；第三、法律保护死者人格不受侵害的目的是为了保护死者近亲属的利益和维护公共利益，一般情形下，只要死者近亲属能证明其诉讼主体的合法性，能够证实侵害"死者人格"的行为已构成侵权，即可推定死者近亲属因此而遭受了精神痛苦——无须举证的"名义上的精神损害"，死者近亲属即可提起精神损害赔偿之诉。

The first part states in a comprehensive way the research on Zhou Zuoren so as to define the purpose, methodology and significance of the dissertation. The second part analyzes the experience of Zhou's self-culture creation from a personal angle-Yue culture in Zhejiang gave Zhou a perceptual knowledge of folklore, while the idea of world folklore gave him a rational cognition of folk' culture. The combination forms a dual folklore. The third part observes Zhou Zuoren's examination of literarure from folklore's perspective as well as its pioneering significance. The fourth part explores in a further way Zhou's perspective of folk culture, and analyzes the method he has established to conduct literary criticism from the angle of folklore as well as his research on Chinese Culture. The fifth part analyzes the impacts folklore theory and folk culture have on the formation of Zhou' literary ideas, focusing more his folklore interpretation and humanism perspective about the origin and hist ory of literature, also his literary aesthetic standards about "ordinary humanism" and "loving amusement" from the position of folklore. The sixth part expounds Zhou's achievement in combining literature and folklore and explores the consistency of their focus on human, thereby presenting a complete picture of Zhou's literature. The last part generalizes the revelation drawing from the research done in this dissertation.

本文分为六章：第一章综述周作人研究的历史与现状，从而确定本文的研究目的、方法及意义；第二章从社会、时代背景、区域文化传统和个人文化选择的角度，阐释周作人选取民俗学视角观照文学的原因，侧重分析周作人自我文化建构的心路历程——浙江越文化传统的浸润给周作人以民俗学的感性认识，而世界民俗学的理念赋予他注重民间文化的理性精神；第三章考察周作人的民俗学研究及先锋意义；第四章进一步探讨周作人的民俗文化观，分析他确立的从民俗文化角度进行文学批评的方法，兼及他从民俗学视角进行的中国文化研究；第五章分析民俗学理论及民俗文化观在周作人文学思想生成中的影响，着重论述周作人关于文学起源和文学发展史的民俗学阐释、文学的民俗人性观，以及从民间立场出发所具有的"平凡的人道"、"有情的滑稽"等文学审美原则；第六章从创作实践方面，探讨周作人文学作品的民俗文化意蕴，进一步论述周作人将文学与民俗结合在一起的实绩，并揭示二者以"人"为核心的内在精神的一致性，从而呈现出周作人较为完整的文学风貌；最后是余论，指出这一研究的启示。

Ltd, based on summarizing and analysizing some references, through researching the present assembly line autoptical and measuring the relevant data, analysizing its balance state by using the diagram of speed, according ECRS and active economic rules, improving time , including splitting and regrouping its intrinsic working procedure, so as to eliminate the bottle-neck phenomenon.

本文以绍兴县精工机电研究所有限公司太阳能结晶炉总装生产线为研究对象，在总结和分析现有相关文献的基础上，通过对现有装配线进行实地考察以及相关数据的测量，使用速度图表分析其平衡状况，根据ECRS原则，改善节拍，包括对原有工序进行拆分、重组，以达到消除瓶颈现象的目的。

A total of 19,781 insect individuals belonging to 959 morphospecies, 145 families and 15 orders were collected. The most abundant orders were Diptera (69.68%), Homoptera (11.19%) and Hymenoptera (10.10%). At the family level, Chironomidae (17.67%), Mycetophilidae (12.32%), Cicadellidae (8.32%), Ceratopogonidae (7.56%), Sciaridae (7.39%) and Cecidomyiidae (5.81%) were the most abundant taxa. Although there were little differences in similarity among the three sampling plots, the dominant orders and families in theses plots differed. The meadow had the highest diversity while the spruce forest had the lowest diversity.

结果：三样区共采集到19，781只昆虫，分属15目、145科、959个形态种；各目的组成百分比，以双翅目(69.68%)、同翅目(11.19%)及膜翅目(10.10%)最为优势；在科的类阶，则是以摇蚊科(17.67%)、蕈蚋科(12.32%)、叶蝉科(8.32%)、糠蚊科(7.56%)、黑翅蕈蚋科(7.39%)及瘿蚋科(5.81%)为优势类群；三个样区的相似度差异不大，但是优势类群则不相同；无论丰度、均匀度及多样性指标，箭竹草原样区均高过於云杉林样区及铁杉林样区。

This thesis started from essential principles and methods of PE, then go for an overall analyzing original training system of XT Company including its active standards and methods. After the analysis, we raise several questions and go for an in-depth discussion. Then we put forward our suggestion that Standards of PE shall be made according to various positions and objectives and the employees who will be evaluated shall also have a voice in making the standards to improve its acceptability. The new PE system is objective oriented by mixed standards system and compellent distributed system etc.

论文从绩效考核的基本理论、方法出发，通过对改制后的XT公司培训体系的全面分析，以及对培训组织的原有考核标准、方法等的剖析，提出了原有的考核存在的几个问题，并就这几个问题深入展开讨论，对绩效考核指标的确定提出了新的要求，即根据绩效期内的工作目标确定考核指标以及被考核者参与制定考核标准与权重，以达到高接受性的目的；应用目标管理法、混合标准量表法等方法制定出以目标为导向的绩效考核方案。
