Article 25 When by-elections are held by the local people's congresses at various levels for chairmen, vice-chairmen, secretaries-general and members of their standing committees, chairmen, and vice-chairmen of the people's congresses of townships, nationality townships or towns, governors, deputy governors, chairmen and vice-chairmen of autonomous regions, mayors, deputy mayors, prefects, deputy prefects, heads and deputy heads of counties, districts, townships and towns, presidents of people's courts, and chief procurators of people's procuratorates, the number of candidates may exceed or equal the number of vacancies, and the election procedures and methods shall be decided by the people's congresses at the corresponding levels.

第二十五条地方各级人民代表大会补选常务委员会主任、副主任、秘书长、委员，乡、民族乡、镇的人民代表大会主席、副主席，省长、副省长，自治区主席、副主席，市长、副市长，州长、副州长，县长、副县长，区长、副区长，乡长、副乡长，镇长、副镇长，人民法院院长，人民检察院检察长时，候选人数可以多于应选人数，也可以同应选人数相等。选举办法由本级人民代表大会决定。

Article 21 Members of the standing committee of local people's congresses at or above the county level, choices for chairmen and vice- chairmen of the people's congresses of townships, nationality townships or towns, governors and deputy governors, chairmen and vice-chairmen of autonomous regions, mayors and deputy mayors, heads and deputy heads of prefectures, heads and deputy heads of counties, districts, townships and towns, presidents of the People's Courts and chief procurators of the People's Procuratorates shall be nominated by the presidiums of the people's congresses at the corresponding levels or jointly nominated by deputies in accordance with the provisions of this Law.

第二十一条县级以上的地方各级人民代表大会常务委员会的组成人员，乡、民族乡、镇的人民代表大会主席、副主席，省长、副省长，自治区主席、副主席，市长、副市长，州长、副州长，县长、副县长，区长、副区长，乡长、副乡长，镇长、副镇长，人民法院院长，人民检察院检察长的人选，由本级人民代表大会主席团或者代表依照本法规定联合提名。

Proposals for the removal from office of a member of the Standing Committee of the National People's Congress, the President or Vice-President of the People's Republic of China, a member of the State Council or the Central Military Commission, the President of the Supreme People's Court or the Procurator-General of the Supreme People's Procuratorate may be submitted by three or more delegations or at least one-tenth of the number of deputies to the National People's Congress.

第十五条全国人民代表大会三个以上的代表团或者十分之一以上的代表，可以提出对于全国人民代表大会常务委员会的组成人员，中华人民共和国主席、副主席，国务院和中央军事委员会的组成人员，最高人民法院院长和最高人民检察院检察长的罢免案，由主席团提请大会审议。

Proposals for the removal from office of a member of the Standing Committee of the National Peoples Congress, the President or Vice-President of the Peoples Republic of China, a member of the State Council or the Central Military Commission, the PresidentoftheSupremePeoples Court or the Procurator-General of the Supreme Peoples Procuratorate may be submitted by three or more delegations or at least one-tenth of the number of deputies to the National Peoples Congress.

第十五条全国人民代表大会三个以上的代表团或者十分之一以上的代表，可以提出对于全国人民代表大会常务委员会的组成人员，中华人民共和国主席、副主席，国务院和中央军事委员会的组成人员，最高人民法院院长和最高人民检察院检察长的罢免案，由主席团提请大会审议。

Members of the State Council, members of theCentral Military Commission, the President of the Supreme People'sCourt and the Procurator-General of the Supreme People'sProcuratorate may attend meetings of the National People'sCongress but without voting rights.

第八条 国务院的组成人员，中央军事委员会的组成人员，最高人民法院院长和最高人民检察院检察长，列席全国人民代表大会会议；其他有关机关、团体的负责人，经主席团决定，可以列席全国人民代表大会会议。

The choices for the Chairman, Vice-Chairmen, Secretary-General and members of the Standing Committee of the National People's Congress, for the President and Vice-President of the People's Republic of China, for the Chairman of the Central Military Commission of the People's Republic of China, and for the President of the Supreme People's Court and the Procurator-General of the Supreme People's Procuratorate shall be nominated by the Presidium.

The term of office of the Procurator-General of the Supreme People's Procuratorate is the same as that of the National People's Congress; he shall serve no more than two consecutive terms.

Candidates for Chairman, Vice-Chairmen, Secretary-General and other members of the Standing Committee of the National People's Congress, President and Vice-President of the People's Republic of China, Chairman of the Central Military Commission, President of the Supreme People's Court and Procurator-General of the Supreme People's Procuratorate shall be nominated by the Presidium which, after consultation among the various delegations, shall decide upon a formal list of candidates, based on the opinion of the majority of deputies.
