In the argument between invention and discovery on patent of biotechnology .I ,firstly, take back look at the definition of invention and discovery in practice of patent of biotechnology in western countries . then ,analyse the possibility of putting the result of basic bioresearch into patent .Finally ,draw a conclusion :we should focus on the achievement of research on natural material and gene invention should be patented as long as the material and gene which have been separated and purified have real value .

关于生物技术专利中的发明与发现之争，本文首先回顾了西方发达国家在生物技术专利实践中对发明与发现的界定，接着分析了生物技术基础研究成果的可专利性，最后得出结论，我们应淡化发明与发现之分，着重于"三性"审查，即只要天然物质和基因被分离和纯化以后具有工业实用性，就应该给天然物质和基因发明等基础研究成果授予专利。
