Chapter 1 is a preface to introduce the motives of this paper research methods scope restriction and frame Chapter 2 will fist introduce the concept of database and then discuss the necessity of database protection in the creating methods and with or without originality This chapter will put emphasis on the importance of originality to database Chapter 3 will observe the British America and Germany's viewpoint of originality to discuss their legislative mode of database legal protection Chapter will introduce EU Directive/96/9/EC of database protection and four judges of EU Court after the Directive takes effect in 2004 to find how the ECJ use the Directive Then according to the DG Internal Market and Service Working Pater and BEUC's evaluation of the Directive this paper will find whether there is positive reaction and influence in database market after EU member countries take the same legislations with the Directive Section 5 will introduce the legislation of British and Germany following the Directive and analyze the development and questions of the two countries' current legislation Chapter 5 will start with Americas case Feist v Jane Doe to understand the case's influence to American legal protection of databases and introduce the Parliament's proposal after the EU Directive Chapter 6 will introduce Japan legislation regarding legal protection of database works and discuss the goodness and badness through Japan academy and judicial viewpoint Chapter 7 will introduce Taiwan's legislation to find whether current law provides enough and adequate protection to databases and discuss whether there is a necessity of amendment At last this paper will try to provide some suggestions about our legislation Chapter 8 is the conclusion of this paper

第二章首先介绍资料库之概念，并以建置方式与是否具原创性区分方式探讨资料库法律保护之必要性，而因著眼原创性对於资料库法律保护之重要性，便於第三章以比较法独立观察英、美、德国对原创性之观点，以接续探讨三国对资料库所采取之立法途径。第四章部份介绍欧盟资料库保护指令之相关规定，并就指令公布后，欧盟法院於2004年接续作出四个关於资料库保护之判决加以介绍，以期寻求欧盟法院如何运用指令规范中之构成要件，而后并参考欧盟委员会工作小组及消费者组织报告对欧体资料库指令之评估文献，探究欧盟各国采取与指令相同立法后，在资料库市场上是否有正面的回应及影响，并於第五节针对英、德两国跟进欧盟资料库保护指令立法之介绍，并归纳、检讨英、德两国之现行法制之发展与所面临之问题。第五章延续第三章、第四章论述后，进入美国1991年Feist案后，美国法院对国内资料库保护之后续见解，探究1991年Feist案对美国资料库保护之影响程度，同时并述美国於欧体公布资料库指令后国会提出之资料库立法草案。第六章则针对日本新增资料库著作之立法模式加以介绍，并藉由日本学界、实务之见解探讨该立法模式之优缺点，再於第七章进入我国法制之介绍，以观察我国目前之法制是否提供资料库充分的保护，探讨资料库立法之必要性，最后尝试提出我国立法模式之建议。第八章则为总结之论述。

The first part is the author"s special viewpoint about the thinking ability, such as the meaning, the essence, the classification and the operating process. The second part describes the relations between developing thinking ability and the urgent needs of country, society and individual development from five aspects. The third part is about the connection and differences of thinking ability, intelligence, ability, creativity and the constructivism theory. The forth part analyses the teachers" nine injudicious actions that will influence the students" thinking ability. The fifth part discusses the students" seven bad learning behaviors that will cause the degradation of thinking ability. The sixth part is about the unsuitable policies or actions adopted by school, society or family that will cause the degradation of the students" thinking ability. The seventh part discusses the countermeasures that can maintain and develop the students" thinking ability. The eighth part brings forward twelve countermeasures that can exercise the student"s thinking ability in chemistry teaching. The last part gives a brief account of the task.The author expects that this article can enhance the coteries" attention to the students thinking ability.

本文共分九个部分，第一部分对思考力的含义及其本质、分类和运行过程提出了作者的观点；第二部分从五个方面阐述培养思考力与国家、社会、个人发展的迫切需要之间的关系；第三部分简要叙述了思考力、智力、能力、创造力与建构主义理论之间的联系和区别；第四部分分析了教师的九种不当行为对学生思考力水平的影响；第五部分分析了学生的七种不良学习行为导致思考力下降的因素；第六部分叙述了学校、社会和家庭的不当政策或行为导致学生思考力水平下降的原因；第七部分着重从八个方面阐述了保持和发展学生思考力的对策；第八部分提出了在化学教学中训练学生思考力的十二种对策；最后在结束语中对本课题主要观点进行了概述，以期望引起教育界同仁对学生思考力培养的重视。

随后选择贝多芬1800年之前创作的三部C小调钢琴作品(《第五钢琴奏鸣曲》、《第八钢琴奏鸣曲》、《第三钢琴协奏曲》)进行研究，并着重第一乐章，从二元冲突、附点节奏、减七和弦、重复音的运用等方面进行具体分析，归纳三部作品在创作背景、总体构思、主题设计、英雄性格等方面的相似之处，从而解释贝多芬对C小调调性的理解与运用以及这三部作品对贝多芬英雄主义风格形成的影响。

Through assessment, it can be concluded that the water quality in Shuimo river valley of Urumqi was worse; the water quality did not improve in last three years, and this trend was not stable either in space or in time; the water quality was best in low water period but it's worse in flush water period and slack water period; in space the water quality in Tangcichangquan section was best , it's the second place in Qifangqiao section and Lianfengqiao section while it's worst in Miquanqiao section. According to the analysis, the trend of the water quality change of Shuimo river valley of the major pollutants, the method of Spearman was used in 1996 to 2002. It concluded, the pollutants did not have the remarkable trend of change in Tangcichangquan section,but BOD5 had very prominent raising trend in Qifangqiao section, so did BOD5, petroleum, and ammoniac nitrogen in Lianfengqiao, DO in Miquanqiao section in seven years.

The following conclusions have been gotten from a large amount of experiments and determinations: Triiodide, pentaiodide, heptaiodide, nonaiodide, undecaiodide of solid tetra-n-butyl ammonium polyiodides and tetrabutyl ammonium bromide polyiodides can be synthesized by solid phase process which is a economic easy way, while its not suitable for synthesizing solid tetramethyl ammonium polyiodides; Solution polyiodides of triiodide, pentaiodide can be synthesized through the complexation process, and TX-10 is a better complexing agent; Triiodide, pentaiodide, heptaiodide resinic polyiodides were synthesized by ion-exchange of resinifying process, and that is a viable easy way.

在大量实验和分析的基础上，可得到以下结论：用固相法可以合成出碘三、碘五、碘七、碘九和碘十一形式的正四丁基多碘化铵固体高聚碘和四丁基多碘化溴化铵固体高聚碘系列化合物，是制备高聚碘的经济、方便的合成方法，但此法对合成四甲基多碘化铵固体高聚碘系列化合物并不适用；TX-10是合成溶液高聚碘较佳的络合剂，通过其络合作用可以合成出碘三和碘五形式的溶液高聚碘；采用树脂法，通过离子交换，合成出了碘三、碘五和碘七形式的树脂高聚碘，此法简单可行。
