After the trust is established, if the trustor dies or disbands according to law, or is canceled or declared bankrupt according to law, and if the trustor is the only beneficiary, the trust shall terminate and the trust property shall be deemed as his heritage or liquidation property; if the trustor is not the only beneficiary, the trust shall continue to exist and the trust property shall not be deemed as his heritage or liquidation property; but if the trustor, as a joint beneficiary, dies or disbands according to law, or is canceled or declared bankrupt according to law, the beneficial right of the trust shall be deemed as his heritage or liquidation property.

If, after the date of the execution of this Agreement, the PRC local or national government or any other local or national public body or authority in the PRC that has the power to make decisions or rules binding upon the JV Company adopts any new PRC Law, amends or repeals any provision of any existing PRC Law, or adopts any different interpretation or method of implementation of any PRC Law ("Change of Law"), and such Change of Law will, upon application by the JV Company and the Party concerned, and upon approval by the relevant government authorities, result in treatment of the JV Company or of any Party substantially more favorable than afforded by the terms of this Agreement (without resulting in less favorable treatment of the other Party), then the JV Company and the Party concerned shall promptly apply to receive the benefits of such more favorable treatment and the other Party shall use all reasonable efforts to facilitate such application.

83Provided always that the Insurer has previously admitted liability under this Policy, any claimant under this Policy shall, at the expense of the Insurer do, and concur in doing and permit to be done all such acts and things as may be reasonably required by the Insurer for the purpose of enforcing any rights and remedies, or of obtaining relief or indemnity from other parties to which the Insurer shall be or would become entitled or subrogated, upon its paying for or making good any loss or damage under this Policy, whether such acts and things shall be or become necessary or required before or after his indemnification by the Insurer

A: As is stipulated in Article 63 of the Law on the Administration of Tax Collection, tax evasion means that a taxpayer forges, alters, conceals or, without authorization, destroys accounting books or vouchers for the accounts, or overstates expenses or omits or understates incomes in the accounting books, or, after being notified by the tax authorities to make tax declaration, refuses to do so or makes false tax declaration, or fails to pay or underpays the amount of tax payable.

The LESSOR reserves the right to grant or use such easement in, over, through, under, or upon land so lease as maybe necessary to the working of the same, or other mineral lands as well as the right to lease, sell, or otherwise dispose of the surface of the land embraced within this Lease under existing law or laws insofar as said surface is not necessary for use by the LESSEE in extracting and removing the mineral deposit from the land covered by this lease or in beneficiation of the ores extracted there from, or from any other mining claim; of to issue such permit for easement herein provided to be reserved and to permit the use of the land covered by this lease, as may be necessary for the construction and maintenance of the mills, mining camps, or other works incident to the mining and milling operation on the lands covered by this Lease or on the any other mineral lands.
