Where the Purchaser under this Agreement is not the assignee personally executing the Assignment of the Property from the Vendor, the Purchaser is hereby required to disclose such information as will enable the Vendor to set out at length in the Assignment full details (including identity card numbers and full addresses) of all confirmors, nominees, sub-purchasers or other intermediate parties who had purchased or sold the Property or any interest therein by any means whatsoever and the full monetary price or other consideration and including any commissions, reservation or agents fees or any other amount which any of the parties knows has been paid or given to any person in connection with any intermediate transaction in addition to the consideration payable to the Vendor for the assignment under this Agreement, and in the event of the failure of the Purchaser and any other intermediate party failing to provide the required information to the satisfaction of the Vendor, the Vendor may notwithstanding anything to the contrary contained in Clause 5 hereof refuse to complete the assignment in favour of any assignee other than the Purchaser under this Agreement without incurring any liability for damages or otherwise to the Purchaser or any of the intermediate parties, whether disclosed or not.

Delivery of all or any part of this order is subject to, and Seller shall not be liable for, and default or delay due to any cause or contingency beyond the Sellers control, including but not limited to non-delivery or delay of raw materials, strikes, lockouts, fires, accidents, delays in transportation, or regulations of the United States or any state, or any government subdivision of either and any order for merchandise not delivered because of any such cause or contingency may, in whole or in part, at Sellers option, without notice or liability, be cancelled.

In consideration of the foregoing Confidential Release of All Claims entered into between Jane Doe and Company X, as defined in the Confidential Release of All Claims, the husband of Jane Doe, John Doe, warrants and covenants for now and in perpetuity not to sue Company X, its predecessors, successors, partners, joint venturers, affiliates, parent companies, related corporations or companies, subsidiaries, divisions, assigns, Board members, officers, employees, agents, servants, specifically including, without limitation, George Washington and Benjamin Franklin, attorneys, suppliers and vendors, specifically including Staffing Agency X and Abraham Lincoln ("Company X"), for any and all debts, claims, actions, conduct or omissions regarding him and his application for employment at Company X, or any other matters and including, but not limited to, claims concerning his wife which were made or might have been made, or by reason of any matter, cause or thing whatsoever arising under any state or federal law or regulation relating to his wife's former employment relationship with Company X, the circumstances of her resignation, or any alleged relationship between Jane Doe and Samuel Adams or any debt of Samuel Adams to Jane Doe or to John Doe as of the date of this Covenant Not To Sue; and

Without prejudice to any other rights which he may have, whether in rem or in personam, the Tugowner, by himself or his servants or agents or otherwise shall be entitled to exercise a possessory lien upon the Tow in respect of any sum howsoever or whatsoever due to the Tugowner under this Agreement and shall for the purpose of exercising such possessory lien be entitled to take and/or keep possession of the Tow; provided always that the Hirer shall pay to the Tugowner all reasonable costs and expenses howsoever or whatsoever incurred by or on behalf of the Tugowner in exercising or attempting or preparing to exercise such lien and the Tugowner shall be entitled to receive from the Hirer the Tug's Delay Payment at the rate specified in Box 29 for any reasonable delay to the Tug resulting therefore.

We have the honour to make this statement on human rights, sexual orientation and gender identity on behalf of 1 - We reaffirm the principle of universality of human rights, as enshrined in the Universal Declaration of Human Rights whose 60th anniversary is celebrated this year, Article 1 of which proclaims that "all human beings are born free and equal in dignity and rights"; 2 - We reaffirm that everyone is entitled to the enjoyment of human rights without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status, as set out in Article 2 of the Universal Declaration of Human Rights and Article 2 of the International Covenants on Civil and Political, Economic, Social and Cultural Rights, as well as in article 26 of the International Covenant on Civil and Political Rights; 3 - We reaffirm the principle of non-discrimination which requires that human rights apply equally to every human being regardless of sexual orientation or gender identity; 4 - We are deeply concerned by violations of human rights and fundamental freedoms based on sexual orientation or gender identity; 5 - We are also disturbed that violence, harassment, discrimination, exclusion, stigmatisation and prejudice are directed against persons in all countries in the world because of sexual orientation or gender identity, and that these practices undermine the integrity and dignity of those subjected to these abuses; 6 - We condemn the human rights violations based on sexual orientation or gender identity wherever they occur, in particular the use of the death penalty on this ground, extrajudicial, summary or arbitrary executions, the practice of torture and other cruel, inhuman and degrading treatment or punishment, arbitrary arrest or detention and deprivation of economic, social and cultural rights, including the right to health; 7 - We recall the statement in 2006 before the Human Rights Council by fifty four countries requesting the President of the Council to provide an opportunity, at an appropriate future session of the Council, for discussing these violations; 8 - We commend the attention paid to these issues by special procedures of the Human Rights Council and treaty bodies and encourage them to continue to integrate consideration of human rights violations based on sexual orientation or gender identity within their relevant mandates; 9 - We welcome the adoption of Resolution AG/RES.
