Stare Decisis：遵从前例

因为法院有另一种功能,所以德国决不采用英美判例法制度的"遵从前例"(stare decisis)的原则. 德国法院判决是发表的,法院也倾向于追随以前案件的推理. 但这种推理的根据并非是法律渊源,而却被认为是对立法机关立法如何被适用和解释(针对法律事实)的陈述.
